These Terms of Service ("Terms") are an agreement between you and Sevensoft Technologies Inc. ("Sevensoft," "we," "us," or "our"). They apply to the websites, mobile applications, and other products that link to these Terms (collectively, the "Services").
1. The Services
Sevensoft develops software that may use artificial intelligence to generate or transform images, video, audio, text, and other content. Features, usage limits, supported models, and availability may vary by product, device, region, or plan. We may add, modify, suspend, rate-limit, or discontinue any part of a Service as permitted by law.
2. Eligibility
You must be at least 13 years old, and at least the minimum age required to consent to digital services in your country, to use the Services. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. If you use a Service for an organization, you represent that you are authorized to bind that organization to these Terms.
3. Accounts
Some Services require an account. You must provide accurate information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account unless applicable law provides otherwise. You may not sell, transfer, or share an account in a way the Service does not permit.
4. Fees, credits, and subscriptions
A Service may be free, ad-supported, credit-based, or paid. Prices, taxes, billing periods, credit rules, and any auto-renewal terms will be shown before purchase. Unless a product-specific policy or applicable law says otherwise, purchases are final and credits have no cash value, are not transferable, and may expire as disclosed at purchase. You authorize us and our payment providers to charge your selected payment method.
You can cancel a renewing subscription through the applicable account or app-store settings. Cancellation stops future renewal charges but does not automatically refund the current billing period. Mandatory consumer cancellation and refund rights remain unaffected.
5. Acceptable use
You may not use the Services to:
- break the law or facilitate fraud, violence, exploitation, or abuse;
- create or distribute child sexual abuse material or any sexualized content involving minors;
- infringe intellectual property, privacy, publicity, confidentiality, or other rights;
- harass, threaten, deceive, defame, or unlawfully discriminate;
- impersonate a person, create deceptive deepfakes, or misrepresent AI output as authentic where disclosure is required;
- make high-impact automated decisions about employment, housing, credit, insurance, education, legal services, or healthcare without lawful and meaningful human review;
- introduce malware, disrupt the Services, bypass safeguards or limits, scrape without permission, or attempt unauthorized access;
- reverse engineer or extract models, source code, system prompts, or datasets except where that restriction is prohibited by law; or
- submit content you do not have the legal right to use or process.
We may investigate suspected violations and remove content, restrict generation, suspend accounts, block access, or cooperate with authorities where appropriate.
6. Your content
You retain your rights in prompts, uploads, and other content you submit ("Your Content"). You grant Sevensoft a worldwide, non-exclusive, royalty-free license to host, reproduce, modify, transmit, and process Your Content solely as needed to operate, secure, improve, and provide the Services, enforce these Terms, and comply with law. This license lasts only as long as necessary for those purposes, subject to our retention obligations and the settings or product notices presented to you.
You represent that you have all rights and permissions needed to submit Your Content and that our processing of it as described here will not violate law or another person's rights. Do not submit confidential or sensitive information unless the applicable Service is designed for it.
7. Generated output
As between you and Sevensoft, and to the extent permitted by law, you own the output generated specifically for you. You may use it for lawful purposes, including commercial purposes, subject to these Terms, product-specific terms, and any third-party rights.
AI output may not be unique, and other users may receive similar output. Laws in some jurisdictions may not recognize copyright or other ownership rights in AI-generated material. You are responsible for reviewing output, obtaining any required permissions, and ensuring your use does not infringe trademarks, copyrights, privacy, publicity, or other rights.
8. AI disclaimer
AI models are probabilistic. Output may be inaccurate, incomplete, offensive, biased, outdated, or unsuitable, and may contain visual or audio artifacts, invented facts, or incorrectly rendered text. Output is not a factual representation and is not professional medical, legal, financial, or other advice. You must independently review and verify output before relying on or publishing it. You are responsible for disclosing AI-generated or manipulated content when required by law or platform rules.
9. Third-party services and models
The Services may rely on third-party AI models, cloud platforms, payment processors, app stores, advertising networks, or integrations. Your use of those features may also be subject to the third party's terms and privacy policy, which may be identified in the applicable product. We are not responsible for third-party products or content and do not control their availability or independent practices.
10. Sevensoft intellectual property
Sevensoft and its licensors own the Services, including the software, interface, branding, designs, documentation, and other materials we provide, excluding Your Content and rights in your generated output. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. No other rights are granted.
11. Feedback
If you provide feedback or suggestions, you grant us a perpetual, worldwide, royalty-free right to use them without restriction or compensation, provided we do not identify you publicly without permission.
12. Suspension and termination
You may stop using a Service at any time and may delete your account where that option is available. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, fail to pay fees, or misuse a Service. Where reasonable and legally required, we will provide notice and an opportunity to appeal. Provisions that should by their nature survive termination will remain in effect.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT. SEVENSOFT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR YOUR PURPOSE, OR THAT OUTPUT WILL BE ACCURATE, APPROPRIATE, UNIQUE, OR FREE OF INFRINGING CONTENT.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEVENSOFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICES OR OUTPUT.
Our total liability for all claims arising from or relating to a Service will not exceed the greater of CAD $100 or the amount you paid Sevensoft for that Service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, our liability is limited to the maximum extent permitted by law, and some limitations above may not apply to you.
15. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Sevensoft and its affiliates, officers, employees, and licensors from claims, damages, losses, liabilities, and reasonable legal fees arising from Your Content, your use of output, your violation of these Terms or law, or your infringement of another person's rights. This section does not apply where prohibited by applicable consumer law.
16. Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer rights, the courts located in Ontario have exclusive jurisdiction over disputes related to these Terms or the Services. Before filing a claim, you and Sevensoft agree to try in good faith for 30 days to resolve the dispute informally by email.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date, and we will provide additional notice where required by law. Your continued use of a Service after the updated Terms take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
18. General terms
These Terms and incorporated product-specific terms are the entire agreement between you and Sevensoft about the Services. If a provision is unenforceable, it will be modified only as much as necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or sale of assets.
